In the Business Process Diagram View there is a tab named <Unspecified> or Process. What I've found is that items that are outside of any Pool have this object as their parent.
The problem I've got is that it is exported in XML exactly like a Pool. Is there an attribute or Property that can be given to it that will differentiate it from the Pools that have a visualization (shape) associated with them?
I need to be able to tell the difference between regular pools and this special case one.

I regret that there is no property for this purpose. How about you give special name to those Pools for better identification?
